Il tema della trasparenza, dell’assistenza amministrativa e dello scambio di informazioni tra autorità fiscali, è da tempo argomento centrale dei vertici internazionali tra gli Stati ed ai primi posti dell’agenda politica delle organizzazioni internazionali non governative. Negli ultimi anni numerosi sono stati gli interventi finalizzati a potenziare la cooperazione internazionale tra gli Stati in materia fiscale, ampliandone gli strumenti e allargandone i confini. Gli Stati, pertanto, si prestano assistenza amministrativa in tutte le fasi che vanno dall’accertamento alla riscossione dei tributi, al fine di proteggere e preservare le proprie entrate fiscali. Da queste considerazioni prende spunto il lavoro che ricostruisce gli strumenti internazionali finalizzati all’accertamento e alla riscossione dei tributi, tenendo conto del necessario coordinamento tra norme convenzionali, europee e interne, e della inevitabile contrapposizione tra interessi pubblici e privati dei soggetti coinvolti, il cui equo bilanciamento costituisce, forse, uno dei punti deboli del sistema che richiede specifici interventi normativi e stimola ulteriori studi.

International corporate tax issues are now prominent in public debate, most notably with the current G20-OECD project addressing Base Erosion and Profit Shifting (‘BEPS’). But, while there is considerable empirical evidence for advanced countries on the cross-country fiscal externalities at the heart of these issues, there is almost none for developing countries. This paper uses panel data for 173 countries over 33 years to explore the magnitude and nature of international fiscal externalities, with a particular focus on developing countries and applying a new method enabling a distinguishing between spillover effects through real investment decisions and through avoidance techniques—and quantification of the revenue impact of the latter. The results suggest that spillover effects on the tax base are substantially larger in developing countries than in advanced, and that they imply a likely loss of revenue from BEPS that is both substantially larger for them.

The outsourcing of military and security services is the object of intense legal debate.
